WHERE IS THE RESPONSIBILITY?

PLEASE EXPLAIN, FACEBOOK:
This screen shot was taken of Facebook on July 13, 2019 at 10:30pm. What more do we need to see? Found was a total of 11 accounts under the names Denny Jack, containing the same photo of Col. Bryan Denny (Ret). There are several other Identity Theft Victims just like Bryan that suffers from this madness day in and day out. How many victims are linked to these accounts? When does facial recognition take place, even AFTER meeting with Facebook several times and giving them 50+ photos to flag (per their request). The owners of these sites create the accounts to scam the innocent, plain and simple.
ADVERTISERS:
So, how much money is going to Facebook from advertisers because they (the advertisers) are led to believe Facebook’s number of active accounts are accurate and authentic? I’m sure the advertisers are aware of the bot account’s and manually built accounts ran by scammers, but do they REALLY have an idea how many are fake and how many will never be a customer of theirs. Guaranteed it’s far more than what is generously provided to them.
CHANGE:
So how do we make a change? We educate! We make people see what is going on within the platforms. Look throughout this site! You will find examples of how the platforms are used as a “business office” for the scammers, just as the “johns/trafficker” did with human trafficking online (which has significantly ceased due to the Human Trafficking amendment to the 230 Communication Decency Act (FOSTA) signed on April 11, 2018.
We will continue to fight for change just as those with FOSTA, showing that scammers are causing harm to the scammed and identity theft victims. Posting victim banking information, victim personal information such as name, address, telephone numbers (to be used as money mules), selling fake government identification (divers license, military identification cards, government identification card), selling of personal photos and scripts to scam etc... there are many facets that can be included in the amendment that would never touch one’s freedom of speech, similar to the fight against online human trafficking. THIS is what needs to change! No more “sitting like a rose”. Platforms are fully aware what occupies their sites, which makes them an accessory to these crimes, something you and I would be responsible for. At this time, Social Media has a “Get Out of Jail Free” card. And just to play “devil’s advocate”, if platforms are not aware of what are on their sites, they have had a substantial amount of time to research and self-regulate. It’s time for Federal Regulations to make platforms safer.

MEETING WITH REPRESENTATIVE KINZINGER`S LEGISLATIVE DIRECTOR
WHERE ARE WE IN THIS FIGHT?
The Legislative Director (LD) began the phone conference by confirming that the need for change amongst our platforms is gaining more attention on the Hill, especially concerning the 230 Communication Decency Act. The LD also mentioned that Congress has been looking at over-hauling the entire law, however by doing this, you are also having to work with the opposing side of freedom of speech and 1st amendment rights. We agree that the entire law needs to be re-written however, at this time, we inquired again how the 230 can be amended under a particular area such as the Human Trafficking, not affecting the freedom of speech like many people anticipate, but holding social media responsible for the criminal acts being allowed to their site. The LD informed us that it can be done however the areas of our focus would result in changes within the civil and criminal codes which would fall more into the Senate Judicial Committee, but not entirely away from the Energy and Commerce.
REP. KINZINGERS STANCE ON AMENDING THE 230
According to the LD, there are several factors that have to strategically be placed before anything on the 230 can be drawn up. This law is a significant factor when it comes to working with big business. Research will be extensive, and the wording must be just right in order for the amendment to have a chance to pass within the House. They are encouraging continued contact and asked for another call at the beginning of August as a follow up to our continued work and their continued engagements on this issue.
SUGGESTIONS FROM LD:
Scheduling more meetings with Representatives and Senators were highly advised. By requesting and attending more meetings brings the education deeper into the legislative community, making this bipartisan issue further recognized. In fact, an option was brought to the table that we reserve a committee room and hold a briefing with those offices that are interested in the subject of amending the 230. Bryan and I both thought this was an excellent idea and very good option when planning for our next set of meetings in 2020. We will however look into and see if this November would be doable for such a presentation.
MOVING FORWARD:
Bryan and I will continue meeting with legislators as the LD suggested. We will also keep the contact open and updated work shared with Rep. Kinzingers’ staff as requested with a follow up phone conference to be scheduled the beginning of August. We do have meetings scheduled for November 2019 with members of the Senate Judiciary Committee and the House’s Energy and Commerce Committee. Seems like change takes forever, but we are absolutely on the right track.
ADDITIONAL INFORMATION:
The LD also informed us that Senator Hawley, of Missouri, just this past June, introduced an amendment to the 230 CDA. This amendment was formed on the basis of removal of automatic immunity for big tech companies but allows the big tech companies the ability to earn the immunity. The amendment will not affect the small and medium sized companies. This law is focusing on the removal practices of the platforms algorithms and the proof they are politically neutral. This is a fantastic step in the right direction for all of us seeking platform safety.

Way to go FB! Another show of your sites inadequate safety and how “great” your reporting process is! How can they say this fake account (Prince Lezy) is within their “Community Standards” for being an authentic account, when they are responding to the real man’s (in the photo) account (Bryan Denny), and even after a personal friend reported! You just can’t make this moronic stuff up! Bryan has received several of these erroneous outcomes from FB over the past few weeks from other personal friends reporting the fake accounts. So after being told this is the way to report... I’m, we, all of us, are at a loss! Don’t worry, we document everything! Oh and did I mention this fake account is ran by a Yahoo Boy (YBNL) and FB STILL gives it their approval!

FACEBOOK: THEIR LACK OF SECURITY, SAFETY, AND POPULATION CONTROL

The letter below, sent on April 5, 2019, is what stemmed the response for the letter above. Looks like the safety, security, and customer appreciation does not hold priority with Mr. Zuckerberg, in fact our question as to why he will not sit with us was completely flouted. Also, take note how the FB Policy Advisor mentions how the safety and security updates are hindered because of the 2 billion accounts currently active on Facebook. Our safety should not be impeded because a company could not or did not limit their accounts parallel to their safety capabilities. Who holds these companies accountable? It`s the 230 CDA that allows the responsibility "get out of jail free" card. Time to AMEND!
"Thank you for responding XXXXX,
As you know, Bryan and I have tried to help for nearly 2 years now with very little results pertaining to the scammers and fraudulent accounts.
To help not only Bryan and I understand, but for all advocates against cyber scams and your customer account holders, can you please elaborate on what has been accomplished in regard to creating, editing or removing systems that will benefit customer security upon Facebook`s platform.
We would also like to follow up with the progress on the groups such as the Yahoo Boys and Gee Guys. We continue to see these sites pop up daily. How are the accounts that promote the sales of fake identities, fake scripts for fake accounts, and military photos etc, along with the "how to`s" of money wiring, creation of fake accounts, and where to find "clients"/Victims, continuing to seep through the cracks? These accounts are not incognito, they are proudly flaunting their criminal activity and using Facebook to house their work.
We are aware these are loaded questions, but I feel you would agree that the issues at hand are significant to your customers safety and security. During Bryan and I`s meetings, we were made aware by the congressional departments and Government agencies, that they are receiving the same information from Facebook that our Facebook team has passed on to us. The disappointment was apparent.
Is there a reason why Mr. Zuckerberg will not sit down with his customers` advocates (Bryan, I and other possible participants) to talk about what can be beneficial to amending the 230, what could negatively affect Social Media with the amendment and how we can all work together to form the best possible answer to this 12 year concern. We love social media! We love to connect with families, make work connections etc. We are by no means trying to harm this industry..just trying to make it a much safer spot for all to enjoy and trust once again.

None of these issues have easy fixes and we do a good deal of proactive screening outside of any requirements directed to us, but as you know, the bad actors are many and very persistent.
We work very closely with the Congressman and we are in constant conversations with him and his team about these issues and many others.
When you meet with his office, they will surely reach out to us with any follow-ups. In the mean time, we are still actively working to mitigate the occurrence of those activities on our platform.

The above is the response we received from Facebook’s Policy Advisor on behalf of the letter we sent on March 11, 2019, requesting a sit-down meeting with Bryan, I and Representative Kinzinger’s legislative staff.
This reply was not a surprise to us, nor is it anything we didn’t already know. We are fully aware that the “bad actors” or a more appropriate definition, criminals, monopolize the platforms and are very determined.
As the Facebook Policy Advisor mentioned, “we do a good deal of proactive screening outside of any requirements directed to us”. This statement may be true, but it’s apparent their definition of “screening” is simply not enough, and allowing accounts to remain, after reporting, that provide “how to’s” of money laundering, and the selling of the following: personal identification, fake forms of identification (driver’s license, passports), Facebook accounts, victim information such as addresses and credit card numbers along with scripts that coincide with the stolen photos, show that these noted attempts have significantly failed. Time for change.
This letter of response was forwarded to Representative Kinzinger’s Legislative Director that we are currently in contact with regarding the proposed amendment.
Now, will Mark Zuckerberg or Sheryl Sandberg respond on behalf of the safety of their members? Where does the importance lie?

FINAL FACEBOOK REQUEST TO WORK WITH US ON THE 230 COMMUNICATION DECENCY ACT

The following letter was sent to our Facebook Policy Advisor contact via email and to Mr. Zuckerberg, CEO of Facebook and Ms. Sandberg COO of Facebook, via snail mail with a signed return receipt requested on March 11, 2019.
Dear Mr. Zuckerberg, March 11, 2019
As you are aware, Colonel Bryan Denny (Ret.) and I provided the Annual Report to Facebook on December 11, 2018, which showed little to no improvement from the initial report provided on October 4, 2017. We were also able to include additional information from facts gathered throughout the year on matters such as the crime-based accounts (ran by gangs on Facebook like the Yahoo Boys and Gee Guys), Facebooks facial recognition outcomes, and the overlooking of Facebook’s own Community Standards, amongst other subjects.
From the findings we provided, Bryan, I and the countless numbers of supporters, feel self-regulation is no longer the answer to these concerns. After 20 years of watching cyber-crime grow amongst our platforms and the numbers of victims soaring, it is now time for Federal Regulations to be put in place.
For the past six months Bryan and I have been in talks with Representative Kinzinger’s Legislative Director, on behalf of amending the 230 Communication Decency Act. Changing this law is not intended to hurt social media companies but to help regain control of the safety and security to their own population amongst platforms. Having the largest social media platform recognize the concerns and issues at hand, will show the public how determined they are in making things right for the future of social media.
We are requesting your presence, in the near future, for a joint meeting with Representative Kinzinger’s office, Bryan, and I, to talk on the changes to the 230, and how we can make platforms a safer, trusting, and more positive experience than what has been recently provided to the public.

NOTES ON MEETING #3 FROM REPRESENTATIVE KINZINGER’S OFFICE

MEETING WITH REPRESENTITIVE KINZINGER’S LEGISLATIVE DIRECTOR
THE NEW HOUSE LEADERSHIP
As we all know, in early January the House of Representatives changed leadership, from Republicans to Democrats. All Representative offices are now having to update their proposing Bills to meet the “likes” of the democratic party. In other words, to better appeal to the Democrats now that they are in leadership, in hopes to move their Bill forward to the Senate. This being said, all new proposals (like ours) will be on hold until approximately March/April, when the older proposals are rewritten and able to be introduce.
SO.....WHERE IS OUR ISSUE?
According to Rep. Kinzingers’ Legislative Director, our issue is “at the top of the stack” of new proposals. He stated the concern is very important, and they do understand the severity since Rep. Kinzinger is an identity Theft victim (like Bryan) and someone the Director knows, fell victim to a romance scam.
MOVING THE AMENDMENT FORWARD...WHAT DOES IT ENTAIL?
Moving the amendment forward takes significant planning. Due to the 230 being such an important Law within the tech community (for their right to self-regulate), there may be a lot of controversy, and roadblocks ahead. In the past, the 230 has been very difficult to amend (lobbyist spending millions of dollars to petition against the changes), however due to all of the breeches, security of safety issues within platforms in the recent years, amending is looking to be more acceptable (there will always be an opposing team). The Legislative Director informed Bryan and I that before they can promise to move our proposal forward and start the amending process, the issues must be presented to the rest of Representative Kinzinger’s team for search of any pitfalls that may occur during the team’s research process. It is also important that the amendment is solid in facts, need, and a matter that Representative Kinzinger can confidently speak to. In other words, Rep. Kinzinger’s team must complete enough research for the amendment to look as though it will pass both Houses (House of Representatives and Senate) with flying colors (only then can the amendment be signed and put in place). We all agreed that it’s apparent there’s significant issues that need changing within the current Law.
The Legislative Director reiterated to be patient with the process, and gave an example of one amendment taking 7 years to push through. He stated that this is not all cases, and many amendments can go through a lot faster with less debatable topics, however this may be a pretty controversial subject, just like when the same law was amended under HUMAN TRAFFICKING ON PLATFORMS.
On another great note, The Legislative Director also mentioned a renew focus on the Privacy Law which may encompass all Identity Theft concerns, including what was presented in our proposal.
In addition, the issue was brought up in regards to groups such as the Yahoo Boys, and how they conduct their business on platforms. We asked if this concern could be somehow absorbed into the amendment, and were told it definitely could. Of course, that would be done by Rep. Kinzinger’s staff and how they could appropriately and legally write the regulatory action on the platforms in regard to the crimes (similar to how Human Trafficking was being conducted on the platform, Backpage).
WHAT WE CAN DO TO HELP THIS ALONG?
Bryan and I asked how we can show more crucial need for this amendment. We were told by the Director how important it is for the congressional leaders to see how this problem affects their constituents. A good way to do this is by keeping up with the petition, which can show what states the signers are from (if provided by the supporter). Also, having an array of signers from all over the world, shows the necessity of the change, not just within the United States (this also helps keep the interest of the congressional leaders). The Legislative Director also mentioned how the media is a great way to get the word out, and by the looks and sounds of it, we are doing a great job with that...and making some waves!
CONCLUDING:
At the end of our conversation the Director stated he is looking forward to staying engaged with us and will be keeping a close eye out on what’s “coming down the pikes”, in other words similar issues and possible news that shows an additional need for the amendment. When asked if a follow up meeting could take place in the next two months, the Director was more than receptive and looking forward to our next follow up.
PERSONAL NOTE:
Bryan and I are aware of the government process and the reasons behind their work and research...but of course we wanted everything done yesterday. We hoped the meeting would be positive for the proposal, and it most definitely was! We are incredibly thankful for every one of you who have stuck by this fight, provided your support and encouragement on this long road and want to stress how even though, on the government end, things may look “stagnant”...it will never be on our end. We will always keep you up to date whether the news is positive or not-so-positive, and we will always give 150% in the name of everyone’s safety and security on social media platforms. It is each and every one of you that encourage Bryan and I to keep up the fight, and we are so blessed to be able to “walk beside you” in this battle of courage, faith and trust.

FACEBOOK’S ANNUAL SUMMARY

As promised I wanted to provide everyone a summary of the annual report we provided to Facebook on December 12, 2018. The information gathered were from the dates of November 1, 2017 to November 1, 2018.
Who at Facebook received the Annual Report: The report was sent via snail mail with a signed return receipt to CEO Mark Zuckerberg, and COO Sheryl Sandberg (see photo above). The remaining Board of Directors (7 members) received their report through basic snail mail. We also provided our Facebook team, which consists of 7 members, including Facebook’s Policy Advisor, the report on December 14, 2018 via email.
The subjects we touched bases on were (See summary of each section below):
1. Reporting findings on Facebook
2. Reporting findings of Instagram
3. Anti-Scam Group Concerns
4. Crime Based Accounts
5. Facial Recognition
6. Facebook Community Standards/Reporting
7. Goals Provided and Met
8. Future
1. Our Facebook report findings showed Kathy to have a 34.37% success rate of deleted fake accounts that contained Col. Denny’s photos from 11/2017 to 4/2018 whereas Col. Denny had a 56.17% success rate of deleting accounts containing his own photos. No records of deletion were recorded passed the given date since the Facebook’s notification system of deleted or “within Community Standards” was ceased.
2. Instagram did not remove any of the reported accounts that Mrs. Waters reported upon the site, therefore all accounts were forwarded to the Facebook team and removed promptly.
3. Concerns voiced on the blocking of members after reporting a number of fake accounts in a short amount of time along with the need of the customer reporters (per Mark Zuckerberg) flagging the fake accounts to keep their platforms safe (you and I being the customer reporters).
4. Provided screen shots of accounts such as the Gee Guys and Yahoo Boys, and the crimes that occur upon Facebook’s platforms within those accounts. Also included a screen shot with a site that contained much of the criminally based acts but was still found to be within Facebook’s “Community Standards”.
5. Screen shots provided to show cropping and shading did not affect the ability to recognize people in pictures, (showing Col. Denny’s name being tagged across the photo after edit). Also, 23 of the 51 photos provided to Facebook by Col. Denny, used by scammers of his own photos, were flagged in the past to avoid being used to build fake accounts; however, the photos are still being found upon the site.
6. Screen shots provided and showed the ability to build multiple accounts (which go against Facebook’s own Community Standards) and visited why this was even an option. Also questions why the option for reporting under “fake accounts” was still primarily based on bot-built accounts and not manually built accounts, thus the reason so many manually built fake accounts, remain on the platform and found to be within Facebooks “Community Standards” after being reported.
7. The initial report suggested updated technology, more man power and additional education. Because metrics could not be provided regarding the man power or proof of updated technology we could not put this under as “goals met”, however Facebook did provide television commercials, advertisements in movie theaters, Subways etc. as well as created a PSA due to our initial report suggestion (per Facebook team), therefore “recognition of accomplished” was noted.
8. As for the future, since there were significant discrepancies found within the safety and security techniques and process of Facebook, we asked for Facebook to join in helping create a strong amendment to the 230 CDA on Identity Theft. Our Facebook team did contact us back prior to sending the report about this request with a clear denial.

It's been a year since working with Facebook on the fake accounts. Our report has been written and ready to send this week! A rendition of the report will be provided in the next week as well.
Will Facebook listen to our findings? Will they accept the need for help for their customers over their want to self regulate?
